Terms of Service

By registering an account or using this forum, you agree to the following Terms of Service. These Terms govern your use of this installation of APBoard ("this forum", "this service"). If you do not agree to these Terms, please do not register or use this service.

1. Scope and nature of this service

This forum is powered by APBoard Next Generation, an open-source discussion forum system. It provides registered users with a place to post topics, reply to discussions, and communicate with other members. The site operator ("we", "us") operates this installation and sets the rules for its use.

If this is a development or test installation, data availability and service continuity are not guaranteed. Content may be removed and data may be reset at any time without prior notice.

2. Eligibility

You must be at least 16 years of age to register an account and use this forum. Users located in the European Economic Area (EEA) are subject to the rights and requirements of the General Data Protection Regulation (GDPR) as described in the Privacy Information.

By registering, you confirm that you meet the minimum age requirement and that all information you provide during registration is accurate and complete.

3. Account registration and security

You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. You must not:

  • share your password with any other person;
  • create accounts on behalf of others without their explicit consent;
  • create multiple accounts to evade restrictions, bans, or moderation decisions;
  • use automated tools to register accounts or post content.

4. Acceptable use

You agree to use this forum only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the service. You must not post, upload, link to, or otherwise transmit any content that:

  • is unlawful, defamatory, threatening, abusive, harassing, hateful, discriminatory, or inciting violence against any person or group;
  • constitutes spam, unsolicited advertising, chain letters, pyramid schemes, or any form of mass or automated solicitation;
  • infringes any copyright, trademark, trade secret, patent, or other intellectual property or privacy right of any person;
  • contains viruses, malware, ransomware, spyware, or any other harmful or disruptive code;
  • impersonates any person, organization, or entity, or falsely represents your affiliation with any person or entity;
  • violates any applicable local, national, or international law or regulation;
  • discloses personal data of other individuals without their consent;
  • attempts to gain unauthorized access to the forum, its systems, or accounts of other users.

5. User-generated content

You retain ownership of the content you post on this forum. By submitting content, you grant the site operator a non-exclusive, royalty-free, worldwide, perpetual licence to store, display, and distribute your content as part of the normal operation of this service. This licence does not give the site operator ownership of your content.

You are solely responsible for the accuracy, legality, and appropriateness of any content you post. The site operator does not pre-screen user content and expressly disclaims any responsibility for content submitted by users.

Content that has been quoted or incorporated into replies by other users may persist even after you delete your original post.

6. Moderation and enforcement

The site operator and appointed moderators reserve the right to remove, edit, move, or lock any content at their sole discretion, at any time and without notice, particularly where content violates these Terms or is otherwise considered harmful to the community.

Violations of these Terms may result in a formal warning, temporary restriction of posting privileges, suspension of your account, or a permanent ban from the service. The severity of the response is at the sole discretion of the moderation team. Moderation decisions are final.

7. Privacy and cookies

Content posted by users remains the property of the respective users. Site-generated content, theme assets, and configuration remain the property of the site operator.

9. External links

This forum may contain links to third-party websites or resources posted by users. The site operator has no control over external content and accepts no responsibility for the availability, accuracy, or legality of third-party sites. Links to external sites do not constitute an endorsement by the site operator.

10. Disclaimer of warranties

This service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The site operator does not warrant that the service will be uninterrupted, error-free, secure, or free from harmful components. Use of this service is at your own risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, the site operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from or in connection with your use of or inability to use this service, even if the site operator has been advised of the possibility of such damages.

The site operator is not liable for content posted by users or for any damages resulting from reliance on user-generated content.

12. Termination

The site operator reserves the right to suspend or terminate your access to the forum at any time, with or without cause and with or without notice, including for violations of these Terms. Upon termination, your right to use the service ceases immediately.

The site operator reserves the right to update or modify these Terms at any time. Changes will be published on this page with an updated date. Your continued use of the forum after changes are posted constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

14. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms or your use of this service shall be subject to the exclusive jurisdiction of the competent courts in Germany, unless mandatory consumer protection laws in your country of residence provide otherwise.
